OVERVIEW
Welcome to PawFev. The terms "we", "us" and "our" refer to PawFev. PawFev operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). PawFev is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully. They include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.
Nothing in these Terms affects your statutory rights as a consumer. Where any provision of these Terms conflicts with mandatory consumer protection law in your country of residence, that law prevails.

These Terms should be read alongside our Refund Policy, Shipping Policy, and Privacy Policy, all of which form part of your agreement with us.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your country of residence, and that you consent to any minor dependents using the Services on devices you own, purchase or manage.
To use the Services, including browsing our store or purchasing any product, you may be asked to provide certain information such as your email address and billing, payment and shipping details. You confirm that the information you provide is correct, current and complete, and that you have the right to provide it.
You are responsible for maintaining the security of your account credentials and for activity on your account. You may not transfer, sell, assign or licence your account to any other person.

SECTION 2 - OUR PRODUCTS
We make every effort to represent our products accurately. Please note that colours and product appearance may differ slightly from how they appear on your screen, depending on your device and its settings.
Product descriptions may change at any time without notice. We may discontinue any product at any time and may limit the quantities we offer to any person, region or jurisdiction.
Products in our Pet Health & Wellness range, including supplements and dental care products, are complementary pet care products and not veterinary medicines. They are not intended to diagnose, treat, cure or prevent any disease or condition. Always consult your veterinarian before introducing a new supplement, and if your pet is unwell.

SECTION 3 - ORDERS
When you place an order you are making an offer to purchase. We may accept or decline an order at our discretion. Your order is accepted when we confirm acceptance, and we must receive and process your payment before an order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order has been accepted and dispatched. If we decline, change or cancel an order, we will contact you using the email address, billing address or phone number you provided.
You may cancel an order free of charge at any time before it is dispatched by emailing support@pawfev.com.
Returns and exchanges are handled in accordance with our Refund Policy.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price charged will be the price in effect when your order is placed, as set out in your order confirmation email. Standard shipping is charged at £4.99 per order and is free on orders of £40.00 and over. Shipping costs are shown to you at checkout before you pay. Prices do not include any customs or import charges levied by the destination country, which are the responsibility of the recipient as set out in our Shipping Policy.
We may run promotions that are governed by their own terms. Where a promotion's terms conflict with these Terms, the promotion terms apply to that promotion.
You agree to provide current, complete and accurate purchase and payment information, and to keep it updated so we can complete your transactions and contact you as needed.
You confirm that the payment details you provide are true and complete, that you are authorised to use the payment method, and that you will pay the charges incurred at the posted prices.

SECTION 5 - SHIPPING AND DELIVERY
Delivery estimates are estimates, not guarantees. Delivery times may be affected by carrier delays, customs processing or events outside our control, and we cannot guarantee a specific delivery date.
However, we do take responsibility for getting your order to you. If your order is lost, delayed beyond a reasonable period, or arrives damaged, we will resolve it as set out in our Shipping Policy - including opening an investigation with the carrier on your behalf and, where a parcel cannot be located, sending a replacement or issuing a full refund. You do not need to contact the carrier yourself.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, video and audio, and the design, selection and arrangement of them, are owned by PawFev or its licensors and are protected by Portuguese, European and international intellectual property law.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you a licence or other rights under any patent, trademark, copyright or other intellectual property of PawFev, Shopify or any third party. All rights not expressly granted are reserved.
PawFev's name, logo, product names, designs and slogans are trademarks of PawFev. You must not use them without our prior written permission. Shopify's name, logo, product names, designs and slogans are trademarks of Shopify. All other names and marks appearing on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be given access to third-party tools as part of the Services, which we neither monitor nor control.
Such tools are provided "as is" and "as available", without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from your use of optional third-party tools. Use of such tools is at your own discretion, and you should satisfy yourself that you accept the terms on which the relevant third-party provider offers them.
We may offer new features through the Services in future. Those features form part of the Services and are subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you leave the Services to access those materials, you do so at your own risk.
We are not liable for harm or damage arising from your access to third-party websites, or your purchase or use of products or services on them. Please review the relevant third party's policies before entering any transaction. Complaints or questions about third-party products and services should be directed to that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
PawFev is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with PawFev. By using the Services you acknowledge that Shopify is not responsible for any aspect of any sale between you and PawFev, including any injury, damage or loss resulting from purchased products and services, and you release Shopify and its affiliates from claims arising from your purchases and transactions with PawFev. Nothing in this section limits PawFev's own obligations to you under these Terms or under applicable consumer law.

SECTION 10 - PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and with third parties that may be located in countries other than the one where you reside, in order to provide the Services to you.
For the purposes of applicable data protection law, including the EU and UK General Data Protection Regulation, PawFev is the data controller of your personal information. You may contact us at support@pawfev.com to exercise your rights.

SECTION 11 - FEEDBACK AND REVIEWS
If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use.
You confirm that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentive received in connection with submitting it; and (iii) your Feedback complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.
We may, but are not obliged to, monitor, edit or remove Feedback we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or which infringes any party's rights or these Terms.
Your Feedback must not infringe any third-party right, must not be unlawful, abusive or obscene, and must not contain any virus or malware. You may not use a false email address, impersonate another person, or mislead us or others about the origin of Feedback. You are responsible for your Feedback and its accuracy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any error and to change or update information at any time without prior notice.
If a pricing or description error affects an order you have already placed, we will contact you before dispatch. You may then confirm the order at the corrected price or cancel it for a full refund. We will not charge you more than the price you agreed at checkout without your consent.

SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to use or re-use material that does not comply with these Terms; (g) to send unsolicited advertising or spam; (h) to impersonate any person or entity; or (i) to engage in conduct that restricts or inhibits anyone's use of the Services, or that may harm PawFev, Shopify or users of the Services.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track others' personal information; (d) spam, phish or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool, AI agent or automated means to access the Services except as permitted in Section 14; or (f) interfere with or circumvent the security features of the Services. We may suspend, disable or terminate your account if we determine that you have breached these Terms.

SECTION 14 - AGENTS
14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed without direct supervision.
14.2 No Agent may access, use or interact with the Services unless it identifies itself and operates in accordance with Section 14.4 at all times. No Agent may access the Services if we have asked it to refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.
14.4 Agents must: (i) identify in all HTTP/HTTPS requests that the request is from an Agent, disclosing its name in the user agent string as "Agent/[agent name]"; (ii) not conceal or obfuscate that access is from an Agent, including by mimicking human interaction patterns or by completing or circumventing CAPTCHAs; (iii) respond truthfully to any question seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit or control Agent access.

SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services at our discretion at any time, and you will remain liable for amounts due up to and including the date of termination. Termination does not affect any order already accepted, or your rights in respect of products already purchased.
The following sections continue to apply after termination: Intellectual Property, Feedback and Reviews, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provision that by its nature should survive.

SECTION 16 - DISCLAIMER OF WARRANTIES
Information presented on or through the Services is provided for general information purposes. We do not warrant that such general information is complete or suitable for every situation, and any reliance you place on it is at your own risk.
Except as expressly stated by PawFev, and subject to the paragraph below, the Services are provided "as is" and "as available" without representations, warranties or conditions of any kind. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.
Nothing in this section excludes or limits any warranty, guarantee, condition or right that cannot lawfully be excluded or limited. In particular, if you are a consumer in the United Kingdom, the European Union, or another jurisdiction with equivalent protections, you retain your statutory rights that goods must be as described, of satisfactory quality and fit for purpose, and nothing in these Terms affects those rights or your remedies for their breach.

SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, and subject to the paragraph below, PawFev and our partners, officers, employees, affiliates, agents, contractors, service providers and licensors, and those of Shopify and its affiliates, will not be liable for any indirect, incidental, punitive, special or consequential loss or damage, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from your use of the Services or of any product purchased through the Services.
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) defective products under applicable product liability law; (d) any breach of your statutory rights as a consumer; or (e) any other liability that cannot lawfully be excluded or limited.
Where our liability is limited rather than excluded, our total liability to you in respect of any order will not exceed the greater of the price you paid for the products in that order or the amount required by applicable law.

SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless PawFev, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. This section does not apply to the extent that a claim arises from our own breach, negligence or wrongdoing.
We will notify you of any claim for which we seek indemnity. We may control the defence and settlement of such a claim, but will not settle any claim requiring non-monetary obligations from you without your consent, which will not be unreasonably withheld.

SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be severed. This will not affect the validity or enforceability of the remaining provisions.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with the policies posted on this site, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements, communications and proposals, whether oral or written.

SECTION 21 - ASSIGNMENT
You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt will be void. We may transfer, assign or delegate these Terms and our rights and obligations, provided this does not reduce your rights under them.

SECTION 22 - GOVERNING LAW AND DISPUTES
These Terms of Service, and any separate agreement under which we provide you Services, are governed by and construed in accordance with the laws of Portugal, and the courts of Portugal have jurisdiction over any dispute arising from them.
If you are a consumer resident in another country, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence, and you may also bring proceedings in the courts of that country.
If you have a complaint, we would always prefer to resolve it directly first - please contact us at support@pawfev.com and we will respond within 1 business day. If we cannot resolve it between us, consumers resident in the European Union may refer the matter to an alternative dispute resolution body in their country of residence, and consumers in the United Kingdom may seek assistance from Citizens Advice.

SECTION 23 - HEADINGS
Headings in this agreement are for convenience only and do not limit or otherwise affect these Terms.

SECTION 24 - CHANGES TO THESE TERMS
You can review the most current version of these Terms of Service at any time on this page.
We may update, change or replace any part of these Terms by posting changes to our website. It is your responsibility to check this page periodically. We will notify you of material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. Changes do not apply retroactively to orders already placed. Your continued use of the Services after changes are posted constitutes acceptance of them.
